INDIVIDUAL MEMBERSHIP AGREEMENT
1. PARTIES OF THE AGREEMENT
This Individual Membership Agreement (hereinafter referred to as MEMBERSHIP AGREEMENT) has been signed electronically between User who wants to became MEMBER of the WWW.TANERSECKIN.COM website and TANER SEÇKİN PHOTOGRAPHY (Hereinafter referred to as “TSP”).
2. DEFINITIONS OF THE AGREEMENT
WEBSITE:The website of www.tanerseckin.com, where the goods and services are offered and the sub-domain names linked to this domain.
USER: Any real person accessing this website
MEMBER:USER, who benefited from the services provided on the site within the determined conditions.

MEMBERSHIP:Rights and Obligations belong to the applicant and cannot be transferred to any third party in whole or in part.
The application for membership can be rejected by the TSP without any reason.

MEMBERSHIP AGREEMENT: MEMBERSHIP AGREEMENT agreed between the parties with the electronic approval of the user in the application.

The MEMBER is liable for any damages that may be incurred or incurred by other Members and / or TSP and / or third parties due to their negligence or defects.
5.1.4. The MEMBER may not transfer this Membership Agreement or its rights and obligations under this Membership Agreement to any third party without the written consent of the TSP.

The TSP may stop or terminate its services and technological infrastructure without prior notice.

6. PRIVACY POLICY

9. PURPOSE OF REASONS

10. APPLICABLE LAW AND AUTHORITY
The implementation of this Membership Agreement, the Membership Agreement interpretation and the Republic of Turkey in the presence of foreign elements in the management of legal relations within the Law and the Law will be applied.
İstanbul ANADOLU (Kartal) Courts and Execution Offices are authorized in any dispute arising out of or arising from this Membership Agreement.
11. VALIDITY OF TSP RECORDS
The Member agrees, declares and undertakes that the electronic and system records and computer records that TSP maintains in its database and servers in disputes arising from this Membership Agreement will constitute binding, definitive and exclusive evidence.
12. APPENDICES OF MEMBERSHIP AGREEMENT

13. ENFORCEMENT
This Membership Agreement and its annexes entered into force upon the approval of the Member by electronic means.
The invalidity, irregularity, or non-compliance of any provision of the Membership Agreement shall not affect the remaining provisions of the contract in force.
BİREYSEL ÜYELİK SÖZLEŞMESİ
1. SÖZLEŞMENİN TARAFLARI
Bu “Bireysel Üyelik Sözleşmesi (bundan sonra “ÜYELİK SÖZLEŞMESİ” olarak anılır ) “TANER SEÇKİN PHOTOGRAPHY” (bundan sonra "TSP" olarak anılır.) ile WWW.TANERSECKIN.COM web sitesine üye olmak için “ÜYELIK SÖZLEŞMESİNE” onay vererek ÜYELİK başvurusu yapmış ve “ÜYELİĞİ” onaylanmış "ÜYE" ler arasında elektronik ortamda imzalanarak yürürlüğe girmiştir.
2. SÖZLEŞME DEKİ TANIMLAR
WEB SİTESİ : www.tanerseckin.com ‘un mal ve hizmetlerini sunduğu alan adı ve bu alan adına bağlı alt alan adlarından oluşan internet sitesi.
KULLANICI : Bu web sitesine erişen her gerçek kişi
ÜYE : Web sitesine ÜYE olan ve sitede sunulan hizmetlerden belirlenen koşullar dahilinde yararlanan KULLANICI.
ÜYELİK : Web sitesi üzerinden üyelik formunu doğru ve gerçek bilgilerleri (kimlik bilgileri, eposta adresi) dolduran KULLANICI nın TSP tarafından onaylanması ve bildirimi ile kazanılan ÜYELİK.
ÜYELİK hak ve yükümlülükleri, başvuruda bulunana ait olup, kısmen veya tamamen herhangi bir üçüncü şahsa devredilemez.
ÜYELİK başvurusu herhangi bir sebep gösterilmeksizin TSP” tarafından reddedilebilir.
TSP gerekli görmesi halinde ÜYE’nin ÜYELİK statüsünü sona erdirebilir.
ÜYELİK SÖZLEŞMESİ : ÜYELİK başvurusunda, kullanıcının verdiği elektronik onay ile taraflar arasında kabul edilen ÜYELİK SÖZLEŞMESİ.
ÜYE HESABI ve SAYFASI : ÜYE”nin sunulan hizmetlerden yararlanmak, promosyonlardan ve diğer duyurulardan haberdar olmak, fotoğrafları , içerikleri beğenmek, sipariş vermek, sipariş takibi yapmak için gerekli olan uygulamaları kullandığı ÜYELİK hesabı ve web sayfasıdır.
Bu web sayfası ÜYE’ye özeldir. Sadece kendisine ait kullanıcı adı ve şifre ile girebilir. İstediği zaman bilgilerinini güncelleyebilir.
TSP HİZMETLERİ :Web sitesi içerisinde ÜYE’nin bu Üyelik Sözleşmesi içerisinde tanımlı olan işlemlerini gerçekleştirmelerini sağlamak amacıyla TSP tarafından sunulan uygulamalardır.
TSP, Web sitesi içerisinde sunulan hizmetlerinde dilediği zaman değişiklikler ve uyarlamalar yapabilir.
İÇERİK : Web sitesinde yayınlanan ve erişimi mümkün olan ve TSP ye ait her türlü bilgi, yazı, dosya, fotoğraf, video, video klip, rakam, baskılı veya baskısız görseller, promosyon malzemeleri, etkinlikler, bloglar, uygulamalar ve dökümanlardır.
TSP WEB SİTESİ : TSP tarafından oluşturulan içeriklerin, sunulan mal ve hizmetlerin yayınlandığı ve satış yapılabilen internet sayfalar bütünü.
Bu internet sayfasının tüm içerikleri ve tasarımı TSP ye aittir ve 5846 Sayılı Fikir ve Sanat Eserleri Kanunu kapsamında korunur.
KİŞİSEL VERİLER :6698 sayılı Kişisel Verilerin Korunması Hakkında Kanun’un (KVKK) 3/d maddesi uyarınca, kimliği belirli veya belirlenebilir gerçek kişiye ilişkin her türlü bilgi ile KVKK m.6/1’de sayılan özel nitelikli kişisel verilerdir.
3. ÜYELİK SÖZLEŞMESİ ninKONUSU VE KAPSAMI
TSP ye ait web sitesindeki hizmetler ve bu hizmetlerden yararlanacak ÜYEler ile tarafların hak ve yükümlülüklerinin tespitidir.
Üyelik Sözleşmesi hizmetlere ilişkin TSP tarafından yapılan tüm uyarı, bildirim, uygulama ve açıklamalar, beyanlar kapsam dâhilindedir.
Kullanıcı Üyelik Sözleşmesi hükümlerini kabul etmekle, web sitesi içinde yer alan kullanıma, üyeliğe ve hizmetlere ilişkin TSP tarafından açıklanan her türlü beyana uygun davranacağını kabul ve taahhüt etmektedir.
4. ÜYELİK ŞARTLARI
4.1 Web sitesine üye olabilmek için reşit olmak, (18 yaşında) gereklidir.
4.2 TSP herhangi bir zamanda gerekçe göstermeden, bildirimde bulunmadan, tazminat, ceza ve benzeri yükümlülüğü bulunmaksızın derhal yürürlüğe girecek şekilde işbu Üyelik Sözleşmesini tek taraflı olarak feshedebilir.
TSP Üyeliğe son verebilir veya geçici olarak durdurabilir.
ÜYE’nin bilgi güvenliği sistemine risk oluşturması durumunda, TSP üyeliğe son verebilir, geçici veya sürekli askıya alabilir.
5. TARAFLARIN HAK VE YÜKÜMLÜLÜKLERİ
5.1 Üye nin Hak ve Yükümlülükleri
5.1.1 ÜYE, web sitesinde belirtilen kurallara, beyanlara, yürürlükteki tüm mevzuata ve ahlak kurallarına uygun hareket edeceğini, Üyelik Sözleşmesi hükümleri ile Gizlilik & Güvenlik Politikasını anladığını ve onayladığını kabul ve taahhüt etmektedir.
5.1.2 ÜYE, TSP nin yürürlükteki mevzuat hükümleri gereğince resmi makamlara açıklama yapmakla yükümlü olduğu durumlarda; ÜYElere ait gizli, özel,kişisel veri,ticari bilgileri resmi makamlara açıklamaya yetkili olduğunu, bu sebeple TSP den her ne nam altında olursa olsun tazminat talep etmeyeceğini kabul ve taahhüt etmektedir.
5.1.3. ÜYEler, web sitesinde Üyelik Hesabına girişte kullandıkları kullanıcı adı ve şifrenin güvenliğini kendileri sağlarlar. ÜYE lerin kendilerine ait olan kullanıcı adı ve şifreyi üçüncü kişilerden saklamaları kendi sorumluluğundadır.
Bu konuda ihmal veya kusurlarından dolayı diğer ÜYElerin ve/veya TSP’in ve/veya üçüncü kişilerin uğradığı veya uğrayabileceği maddi ve veya manevi her tür zararlardan ÜYE sorumludur.
5.1.4. ÜYE, TSP in yazılı onayı olmadan bu Üyelik Sözleşmesini veya bu Üyelik Sözleşmesinin kapsamındaki hak ve yükümlülüklerini kısmen veya tamamen herhangi bir üçüncü kişiye devredemez.
5.1.5. ÜYE mal ve hizmetlerden haberdar olmak, duyuruları takip etmek, promosyonardan haberdar olmak, sipariş vermek, sipariş takibi yapmak için, kendisinize özel Üyelik sayfasından işlem yapabilir, bilgilerini güncelleyebilir.
ÜYEnin, web sitesi dahilinde yaptığı her işlem ve eylemdeki hukuki ve cezai sorumluluk kendisine aittir.
ÜYE, TSP’in ve/veya başka bir üçüncü şahsın şahsi haklarına, malvarlığına, kişisel verilerine tecavüz teşkil edecek niteliktek paylaşımlar yapmayacağını kabul ve taahhüt eder.
ÜYE, içerikleri, resimleri, videoları, metinleri, görsel ve işitsel medyaları, video klipleri, dosyaları, veritabanları, katalogları ve listeleri çoğaltmayacağını, kopyalamayacağını, dağıtmayacağını, işlemeyeceğini, başka veritabanına aktarmayacağını veya bu nitelikte sonuçlar doğurabilecek şekilde bu web sitesine ve başka web stelerine yüklemeyeceğini kabul ve taahhüt eder.
ÜYE ayrıca bu tür eylemler gerçekleştirerek herhangi bir ticari faaliyette bulunmayacağını; gerek bu eylemleri ile gerekse de başka yollarla doğrudan ve veya dolaylı olarak haksız rekabet teşkil eden davranış ve işlemler gerçekleştirmeyeceğini kabul ve taahhüt eder.
ÜYEler bu Üyelik Sözleşmesi hükümlerine ve hukuka aykırı olarak bu web sitesi üzerindeki gerçekleştirdikleri faaliyetler nedeniyle üçüncü kişilerin uğradıkları veya uğrayabilecekleri zararlardan dolayı TSP yi doğrudan ve veya dolaylı olarak hiçbir şekilde sorumlu tutulamaz.
5.2. TSP nin Hak ve Yükümlülükleri
5.2.1. TSP, bu Üyelik Sözleşmesinde bahsi geçen hizmetleri, açıklamalar ve koşullar dâhilinde yerine getirmeyi, gerekli olan teknolojik altyapıyı tesis etmeyi, işletmeyi kabul ve taahhüt eder.
TSP önceden herhangi bir bildirimde bulunmadan hizmetleri ve teknolojik altyapısını durdurabilir veya son verebilir.
5.2.2. TSP, sunulan hizmetleri ve içerikleri değiştirebilme, içerikleri kullanıcıları da dâhil olmak üzere üçüncü kişilerin erişimine kapatabilme ve silme hakkını saklı tutar.
TSP, bu hakkını hiçbir bildirimde bulunmadan kullanabilir.
5.2.3. TSP web sitesi üzerinden, kendi kontrolünde olmayan web sitelerine link verebilir. TSP bu linkler vasıtasıyla erişilen sitelerin gizlilik uygulamaları ve içeriklerine yönelik herhangi bir sorumluluk taşımamaz.
TSP ye ait sitede yayınlanan reklamlar, reklamcılık yapan iş ortakları aracılığı ile KULLANICI ve ÜYElere dağıtılır.
Bu Üyelik Sözleşmesindeki Gizlilik ve Güvenlik Politikası Prensipleri, sadece TSP ya ait web sitesi kullanımına ilişkindir, üçüncü taraf web sitelerini kapsamaz.
6. GİZLİLİK POLİTİKASI
TSP çeşitli amaçlarla kişisel veriler toplayabilir.
Üyelik veya web sitesi üzerindeki çeşitli form ve anketlerin doldurulması suretiyle üyelerin kendileriyle ilgili bir takım kişisel bilgileri (isim-soy isim, firma bilgileri, telefon, adres veya e-posta adresleri gibi) TSP tarafından işin doğası gereği toplanmaktadır.
TSP bazı dönemlerde müşterilerine ve üyelerine kampanya bilgileri, duyurular, yeni ürünler hakkında bilgiler, promosyon teklifleri gönderebilir. Üyelerimiz bu gibi bilgileri alıp almama konusunda her türlü seçimi üye olurken yapabilir. Sonrasında üye girişi yaptıktan sonra hesap bilgileri bölümünden bu seçimi değiştirilebilir ya da kendisine gelen bilgilendirme iletisindeki linkle bildirim yapabilir.
Web sitesi üzerinden veya eposta ile gerçekleştirilen onay sürecinde, üyeler tarafından TSP elektronik ortamdan iletilen kişisel bilgiler, Üyeler ile yapılan Üyelik Sözleşmesi ile belirlenen amaçlar ve kapsam dışında üçüncü kişilere açıklanmayacaktır.
TSP Üyelik Sözleşmesi ile belirlenen amaçlar ve kapsam dışında talep edilen bilgileri, kendisi veya işbirliği içinde olduğu kişiler tarafından doğrudan pazarlama yapmak amacıyla kullanabilir. Kişisel bilgiler gerektiğinde kullanıcıyla temas kurmak için de kullanılabilir. Bu bilgiler üyelerimizin kimliği açıklanmadan çeşitli istatistiksel değerlendirmeler, veri tabanı oluşturma ve pazar araştırmalarında kullanılabilir.
TSP gizli bilgileri kesinlikle özel ve gizli tutmayı taahhüt eder.
Bu bilgilerin gizliliğin sağlanması ve sürdürülmesi için gerekli tedbirleri alır.
Tamamının veya herhangi bir kısmının kamu alanına girmesini veya yetkisiz kullanımını veya üçüncü bir kişiye ifşasını önlemek için gerekli tüm tedbirleri almayı ve gerekli özeni göstermeyi taahhüt etmektedir.
7. FİKRİ MÜLKİYET HAKLARI
Üyeler, TSP‘in hizmetlerini, bilgilerini, içeriklerini ve telif haklarına tabi çalışmalarını kopyalamayamaz, çoğaltamaz, satamaz, işleyemez, paylaşamaz, dağıtamaz, sergileyemez ve bunlardan türemiş çalışmalar yapamaz.
Bu tarz çalışmalar yapmak isteyen Kullanıcı ve Üyeler TSP den yazılı izin ve onay almak durumundadır.
8. ÜYELİK SÖZLEŞMESİ DEĞİŞİKLİKLERİ
TSP, tamamen kendi takdirine bağlı ve tek taraflı olarak işbu Üyelik Sözleşmesini uygun göreceği herhangi bir zamanda web sitesinde yayınlayarak değiştirebilir.
Bu Üyelik Sözleşmesinin değişen hükümleri, web sitesinde yayınlandığı tarihte geçerlilik kazanır ve yürürlüğe girer. Geri kalan hükümler aynen yürürlükte kalarak hüküm ve sonuçlarını doğurmaya devam edecektir. Bu Üyelik Sözleşmesi, Üyenin tek taraflı beyanları ile değiştirilemez.
9. MÜCBİR SEBEPLER
Hukuken mücbir sebep sayılan tüm durumlarda, TSP bu Üyelik Sözleşmesi ile belirlenen hizmetlerden herhangi birini geç veya eksik ifa etme veya ifa etmeme nedeniyle yükümlü değildir. Bu ve bunun gibi durumlar, TSP için, gecikme, eksik ifa etme veya ifa etmeme veya temerrüt addedilmeyecek veya bu durumlar için TSP den herhangi bir tazminat talep edilemez. Mücbir sebep terimi; doğal afet, isyan, savaş, grev, iletişim sorunları, altyapı ve internet arızaları, sisteme ilişkin iyileştirme veya yenileştirme çalışmaları ve bu sebeple meydana gelebilecek arızalar, elektrik kesintisi ve kötü hava koşulları da dâhil ve fakat bunlarla sınırlı olmamak kaydıyla ilgili tarafın makul kontrolü haricinde ve TSP’in gerekli özeni göstermesine rağmen önleyemediği kaçınılamayacak olaylar olarak yorumlanacaktır.
10. UYGULANACAK HUKUK VE YETKİ
Bu Üyelik Sözleşmesinin uygulanmasında, yorumlanmasında ve bu Üyelik Sözleşmesi dâhilinde doğan hukuki ilişkilerin yönetiminde yabancılık unsuru bulunması durumunda Türkiye Cumhuriyeti Kanunları ve Hukuku uygulanacaktır. Bu Üyelik Sözleşmesinden dolayı doğan veya doğabilecek her türlü ihtilaf hallinde İstanbul ANADOLU (Kartal) Mahkemeleri ve İcra Daireleri yetkilidir.
11. TSP KAYITLARININ GEÇERLİLİĞİ
Üye, bu Üyelik Sözleşmesinden doğabilecek ihtilaflarda TSPin kendi veritabanında, sunucularında tuttuğu elektronik ve sistem kayıtlarının ve bilgisayar kayıtlarının bağlayıcı, kesin ve münhasır delil teşkil edeceğini kabul, beyan ve taahhüt eder.
12. ÜYELİK SÖZLEŞMESİNİNEKLERİ
Üye,
Site Kullanım Sözleşmesi,Gizlilik ve Güvenlik Politikası,Mesafeli Satış Sözleşmesi eklerinin bu Üyelik Sözleşmesinin ekleri ve ayrılmaz bir parçası olduğunu, içeriklerini okuyup anladığını, Üye olarak Üyelik Sözleşmesi ile eklerine uygun davranacağını kayıtsız ve şartsız olarak kabul ettiğini beyan ve taahhüt eder.
13. YÜRÜRLÜK
Bu Üyelik Sözleşmesi ve eklerine, Üyenin elektronik olarak onay vermesi ile yürürlüğe girmiştir.
Üyelik Sözleşmesinin herhangi bir hükmünün geçersizliği, mevzuata aykırılığı veya uygulanabilir olmaması sözleşmenin geri kalan hükümlerinin yürürlükte olduğunu etkilemeyecektir.
